
1.0 INTRODUCTION
When a customer ("you") wants to sign up for the internet service (the "Service"), AirComPlus Inc. ("AirComPlus") requires the customer to provide certain personal information such as your name, address, telephone number, social status, payment information and credit records. While AirComPlus is committed to provide you the most enjoyable and rewarding internet experience, your privacy is paramount for AirComPlus.
This Privacy Policy describes how the personal information collected by AirComPlus is used and ways in which you can make certain precaution when using the Service or any other auxiliary services described in Service Agreement or Terms and Conditions available at www.aircomplus.com.
AirComPlus reserves the right to modify, change or amend this Privacy policy at any time. The most recent Privacy Policy is available at www.aircomplus.com. Please, read this Privacy Policy before using the Service.
2.0 USE OF INFORMATION
AirComPlus collects the personal information with an implied consent to provide the Service and to have a commercial relationship with its customers. The personal information may also be collected from third-parties such as credit bureau who have the right to disclose.
AirComPlus may share your personal information with certain business affiliates of AirComPlus in order to provide the Service to you and to manage and administer its business operations. These business affiliates are not allowed to use AirComPlus data for any purpose other than providing the Service or any other auxiliary services or to manage and administer AirComPlus business operations.
It is a general policy of AirComPlus not to share the personal information with third-parties other than described above. However, AirComPlus reserves the right to disclose the information regarding the use of the Services, in its sole discretion, if AirComPlus believes that it is reasonable to do so to satisfy other policies and laws.
Data collected during any voluntary surveys conducted by AirComPlus will remain confidential and will be processed to produce generic information without reference to any personal identification. Such generic information may be shared with certain business affiliates of AirComPlus with a view to proving better services.
In order to serve you better, AirComPlus may use “cookies”, data files placed on your hard disk when you are visiting certain Web sites, as the information in the “cookies” may enable AirComPlus to avoid, to certain extent, duplication of data uploading and downloading into your computer. Customers who don’t want to use “cookies” can reset the browser accordingly.
AirComPlus employees dealing with the personal information are bound by a non-disclosure agreement prohibiting the use of the personal information other than the business purpose of AirComPlus. Although AirComPlus has taken all security measures and upgrades the security system periodically to protect the personal information in the possession of AirComPlus, it does not guarantee that the security system is perfectly “hacker-proof” from illegal access by any third-parties.
3.0 DEALING WITH THIRD-PARTIES
When you are doing online shopping for various products and services, you may have to provide your contact information to a third-party Web sites. This information may include your name, address, email address, phone number, and credit or bank information. In the case of sending an online gift to someone else, you may have to provide the personal information of the recipient, such as the recipient’s name, address, and phone number. In these or any other similar cases, AirComPlus can not guarantee the privacy over or the personal information you provide when placing such orders, since these third-party web sites and their use of any personal information are beyond the control of AirComPlus.
Personal information disclosed in online forums or any similar areas may become available to the public. Therefore, any potential risk of making such disclosure should be understood before using such internet features.
There are Web sites with third-party advertising companies that may monitor the browsing habits of their registered users. If you a registered member of such a Web site, that company may use information about your visits to various Web sites in order to provide advertisements on that site and other sites about goods and services that may be of interest to you. 4.0 ACCESS TO INFORMATION
When a customer wants to access his or her complete or partial personal information for such reason as to make sure the accuracy or informs any changes, the customer will be asked by AirComPlus to get sufficient information to locate the account details. AIRCOMPLUS INTERNET SERVICE AGREEMENT
THE FOLLOWING IS AN AGREEMENT TO USE ANY AIRCOMPLUS INTERNET SERVICE.
BY ACTIVATING OR USING THE SERVICE, YOU REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO THIS AGREEMENT AND THAT YOU HAVE READ AND UNDERSTAND FULLY ITS TERMS AND CONDITIONS.
1. DEFINITION
(A) AirComPlus: AirComPlus Inc. and its employees and agents involved in the provision of Internet access service.
(B) The Service: Internet access service or any other auxiliary services provided by AirComPlus
(C) Service Plan: A combination of different services included with the Service such as email, webspace, equipment, software etc.
(D) You or Your: customer, an individual or a business entity who has subscribed for the Service.
2. AGREEMENT
Read this agreement before using any AirComPlus Internet Service. This agreement is between AirComPlus and you to use the Service. When you subscribe for the Service, you agree to be bound by this agreement, including future revisions of this agreement. The most updated version of this agreement and other policy information are found at www.aircomplus.com.
3. REQUIREMENTS
To apply and qualify for the Service, you may have to meet several requirements, including but not limited to the followings:
(A) You must be at least 18 years of old.
(B) You may have to provide a valid credit card or other methods of payment.
(C) You may have to have an active telephone at your location.
(D) Your computer may have to meet certain minimum requirements.
(E) The Service must be available at your geographical area.
4. THE SERVICE
Depending on the availability of the Service in your geographical area at the time you sign up, you may have an option to choose between different Service Plans. Features of these Service Plans, wholly or partly, may be changed, modified or terminated at any time by AirComPlus. By subscribing the Service, you agree to be responsible for paying all charges arising from such changes or modifications of the features of the Service Plan. Updated details of the Service Plans may be obtained by browsing our website at www.aircomplus.com or calling 416-CONNECT (416-266-6328).
Identifying different Service Plans by the speed is not a guarantee by AirComPlus on upload or download speeds, as the speed of the Service depends on various factors including location, line quality, inside wiring, Internet traffic, and other factors beyond the control of AirComPlus.
Depending on your choice, your Service Plan may limit the amount of data that you can upload and/or download on a monthly basis and if you exceed the limit, you may be charged for an additional fee based on your Service Plan. Unless your service includes a Static IP, you will be allocated a Dynamic IP address.
In the case of exceeding email space limit, depending on the service plan you selected, AirComPlus has the right to suspend the email service, transfer to a compressed temporary file, store in a temporary location, or to delete the emails.
5. CANCELLATION
The Service can only be cancelled by phone, fax or mail. AirComPlus does not accept cancellation request by email. On cancellation, you are given a confirmation code as a proof of cancellation and accounts are closed at the end of the current billing cycle. AirComPlus does not prorate bill for partial use during the billing cycle of cancellation. Refunds will be provided for billing due to mistake even after cancellation by any of the above-mentioned method. You may be charged for any cancellation fee, if you cancel the Service within the specified minimum contractual service period you agreed to retain the Service Plan. The cancellation charge may be up to half the sum of the charger for the remaining number of months of the contractual period. Cancellation request should include name of the account holder, address and current phone number of the existing Service. Your use of the Service, your password, your account or any part of this agreement may be cancelled, suspended or terminated by AirComPlus, in its sole discretion, for any reason without limitation or if AirComPlus believes you:
(A) Violate this agreement;
(B) Fail to meet required credit eligibility by AirComPlus;
(C) Fail to pay any charges when due;
(D) Become bankrupt or insolvent;
(E) Misuse AirComPlus Equipment;
(F) Use the Service violating acceptable policy of AirComPlus; or
(G) Threat, abuse, harass, or are unreasonable to AirComPlus or to its employees and agents.
Any such cancellation, suspension or termination by AirComPlus will be notified by email or mail to the address you provided for the Service.
6. AIRCOMPLUS EQUIPMENT
Depending on your choice of the Service Plan, you may be provided with AirComPlus Equipment to your use of the Service. By this agreement, you agree that AirComPlus Equipment remains the property of AirComPlus at all the times without any liens on them. AirComPlus Equipment is assumed to be in working condition upon sending by AirComPlus unless you inform AirComPlus within 5 business days of receiving them. If you choose to use your own equipment, AirComPlus may not provide support for such equipment and does not guarantee the performance of the Service.
7. RETURN OF EQUIPMENT
In the case of cancellation or termination of the Service, this agreement binds you to return all AirComPlus Equipments within 30 days of cancellation. If you fail to return within the time frame, you may be charged for the replacement cost of such equipment.
8. YOUR SECURITY
When you sign up for the Service, you will be given a username and password, and other information for easy guidance to obtain the Service. It is your responsibility to keep your password confidential so that no unauthorized access to the Services through your account. You must notify AirComPlus immediately upon discovering any unauthorized use of your account.
9. MONITORING THE SERVICES
AirComPlus reserves the right to monitor the Services and disclose information regarding the use of the Services for any reason, in its sole discretion, if AirComPlus believes that it is reasonable to do so. AirComPlus may remove, in whole or in part, your material or information from AirComPlus’s servers, if AirComPlus determines to infringe another's property rights or to violate our Policy or other policies or laws.
10. BILLING
The services are generally billed in advance and payment is due in approximately twenty days after the billing date. First statement will be sent within about 15 days after the service is activated. AirComPlus has two billing cycles per month: 1st and 16th of each month. For instance, if a customer activates the Services on August 2, 2006, the first statement for the customer will have a billing date of August 16, 2006 and the due date will be September 5, 2006. If a customer activates the Services on August 18, 2006, the first statement for the customer will have a billing date of September 1, 2006 and the due date will September 20, 2006.
Since your account is billed in advance, your first bill will include a charge pro-rated for the number of days in the first billing cycle plus a charge for the next one full month. These charges are subject to taxes based on federal and provincial tax laws.
The following methods are available for paying the bill:
(A) Cheque/money order: Mail your personal cheque made payable to AirComPlus Inc with the coupon attached to the bill. AirComPlus may impose a $25 charge if your cheque is returned or credit card is denied.
(B) Pre-authorized payments: Automatic payment is withdrawn from a specified bank of your choice.
(C) Pre-authorized credit card payment: Automatically billed to your credit card each month.
(D) Credit card payment by phone: AirComPlus accepts payment over the phone by using your credit card on a monthly basis.
